Terms and Conditions for Content and Lab Creators
Welcome to Cyberyami. These Terms and Conditions ("Terms") govern the submission of content and labs ("Labs") by creators ("Creators") under the one-time payment model. By submitting a Lab, you agree to be bound by these Terms.
1. Submission Process
Creators must follow the submission process outlined on the Cyberyami Lab Submission page, which includes:
- Review: All submissions undergo an initial review to ensure compliance with Cyberyami’s quality and technical standards.
- Testing: Labs will be tested by Cyberyami to ensure functionality, accuracy, and security compliance.
- Acceptance: Cyberyami reserves the right to accept or reject submissions based on internal evaluation criteria.
- Payment Processing: Once a Lab is accepted, the payment process will be initiated as per the agreed compensation.
- Tracking Submission Progress: Creators can monitor the status of their submission through Cyberyami’s platform.
2. Content Ownership and Licensing
- Upon acceptance and payment, Cyberyami acquires full ownership of the Lab and its associated content.
- The Creator agrees that Cyberyami has exclusive rights to modify, distribute, and utilize the Lab in any manner.
- The Creator warrants that they hold all necessary rights to the submitted Lab and that it does not infringe upon any third-party rights.
3. Payment Terms
- Payment will be made as a one-time, fixed amount agreed upon before submission.
- 50% of the payment will be made within 7 days upon acceptance of the Lab.
- The remaining 50% will be processed within 7 days after the Lab is made live on Cyberyami.
- Payments will be made via wire transfer or ACH for creators outside India and via NEFT for creators in India.
- Any applicable taxes or deductions will be the responsibility of the Creator.
4. Warranties and Representations
By submitting a Lab, the Creator represents and warrants that:
- The Lab is original and does not violate any third-party intellectual property rights.
- The Lab is free from malware, security vulnerabilities, or any malicious content.
- The Lab complies with all applicable laws and Cyberyami's submission guidelines.
5. Rejection and Resubmission
- If a Lab is rejected, Cyberyami will provide feedback where applicable.
- Creators may resubmit the Lab after making the necessary modifications.
- Cyberyami reserves the right to limit the number of resubmissions.
6. Termination
- Cyberyami may terminate or revoke the agreement at any time if the Creator breaches these Terms.
- If termination occurs after payment, the Creator shall have no further rights over the Lab.
7. Confidentiality
- All submissions, until officially accepted, will be considered confidential.
- Creators must not disclose or share details of their submissions publicly or with third parties.
8. Limitation of Liability
- Cyberyami is not responsible for any loss, damages, or claims arising from the submission, acceptance, or rejection of Labs.
- Cyberyami's total liability shall not exceed the one-time payment agreed upon for the accepted Lab.
9. Governing Law and Dispute Resolution
- These Terms shall be governed by and construed under the laws of India.
- Any disputes arising under these Terms shall be settled through arbitration in Noida, India, in accordance with Indian arbitration laws.
10. Modifications to Terms
Cyberyami reserves the right to modify these Terms at any time. Changes will be communicated through the Cyberyami platform, and continued submissions will constitute acceptance of the revised Terms.
