This Candidate Agreement ("Agreement") is entered into between the candidate ("Candidate") and CyberYami, establishing the terms and conditions for participation in CyberYami's certification exams.
1. Introduction
1.1. Scope:
This Agreement governs the relationship between the Candidate and CyberYami regarding the certification exams offered by CyberYami.
2. Registration and Eligibility
2.1. Registration:
The Candidate agrees to provide accurate and truthful information during the registration process for CyberYami's certification exams.
2.2. Eligibility:
The Candidate confirms compliance with the prerequisites and eligibility criteria for the chosen certification exam.
3. Exam Policies
3.1. Exam Format:
The Candidate acknowledges the performance-based and practical nature of CyberYami's certification exams.
3.2. Code of Conduct:
The Candidate agrees to abide by CyberYami's Code of Conduct throughout the entire examination process, promoting ethical behavior and professional conduct.
3.3. Technical Requirements:
The Candidate is responsible for ensuring that their computer system meets the specified technical requirements for a smooth exam experience.
4. Fees and Payment
4.1. Payment Responsibility:
The Candidate agrees to pay the required fees for exam registration, retakes, or any additional services as applicable.
4.2. Fee Structure:
The Candidate acknowledges the fee structure outlined by CyberYami and agrees to adhere to the payment terms.
5. Retake Policy
5.1. Retake Eligibility:
The candidate acknowledges that there is no waiting period prior to attempting the retake exam if the candidate fails a particular exam however if the candidate fails the second exam the candidate acknowledges the waiting period of 14 days required after the last exam failure before becoming eligible for a retake.
5.2. Retake Fees:
The Candidate understands that retake attempts may involve additional fees and agrees to the payment terms specified by CyberYami.
6. Exam Vouchers
6.1. Voucher Terms:
Exam vouchers are valid for one year from the date of purchase, and the Candidate agrees to adhere to the terms and conditions associated with voucher usage.
7. Appeals Process
7.1. Appeal Submission:
The Candidate acknowledges the right to appeal exam results within 7 days of receiving scores.
7.2. Appeal Procedure:
The Candidate agrees to follow the designated appeal process, submitting a written appeal within the specified timeframe, including relevant documentation and a detailed explanation of the grounds for appeal.
7.3. Decision Finality:
The Candidate understands that CyberYami's decision regarding the appeal is final and binding.
8. Privacy and Data Protection
8.1. Data Usage:
8.2. The Candidate acknowledges and consents to the collection and use of personal data for exam-related purposes in accordance with CyberYami's Privacy Policy.
9. Confidentiality of Exam Material
9.1. Confidentiality Obligation:
The Candidate agrees to maintain the utmost confidentiality of all exam content encountered during and after the examination.
9.2. Non-Disclosure:
The Candidate shall not disclose, reproduce, or distribute exam content, in part or in whole, to any third party, directly or indirectly.
10. Confidentiality and Security
10.1. Confidentiality:
The Candidate agrees to maintain the confidentiality of exam content and any proprietary information encountered during the examination process.
10.2. Security Measures:
The Candidate understands and accepts the implementation of security measures during the exam to ensure integrity and fairness.
11. Certification Validity and Renewal
11.1. Certification Expiry:
The Candidate acknowledges that certifications are valid for 3 years and agrees to renew by retaking the exam as per CyberYami's policies.
12. Score and Passing Criteria
12.1. Scoring Methodology
The Candidate understands that scores are calculated based on the accuracy and completeness of the tasks performed during the exam.
12.2. Passing Criteria:
The Candidate must achieve a minimum passing score as specified by CyberYami to obtain certification.
13. Indemnification
13.1. Candidate's Responsibility:
The Candidate agrees to indemnify and hold CyberYami harmless from any claims, losses, or damages arising from or in connection with the Candidate's participation in the certification exams.
14. Disclaimer; Limitation of Liability
14.1. Disclaimer:
CyberYami makes no warranties, express or implied, regarding the certification exams, including but not limited to the accuracy, completeness, or fitness for a particular purpose of the exam content.
14.2. Limitation of Liability:
CyberYami shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with the Candidate's participation in the certification exams.
15. Governing Law and Dispute Resolution
15.1. Applicable Law:
This Agreement shall be governed by and construed in accordance with the laws of Uttar Pradesh, India.
15.2. Dispute Resolution:
Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts in Noida, Uttar Pradesh, India.
16. Amendments to the Agreement
16.1. Policy Updates:
The Candidate acknowledges that CyberYami reserves the right to update this Agreement as needed, and it is the Candidate's responsibility to review and adhere to the most current terms.
By participating in CyberYami's certification exams, the Candidate agrees to the terms and conditions outlined in this Agreement. This Agreement supersedes any prior agreements or understandings between the parties and may be updated by CyberYami as necessary.
